Traffic Tickets And Court Tips / How To Avoid Paying Traffic Fines

We all get them or have had them and if you are one of those miraculous people who have not obtain one of these then be prepared sooner or later to receive with much pleasure from your state police officers. The whole point is that they exist and one is coming whether we like it or not. The question now is, what is the best way to deal with them? And also how to handle the entities of insurance, warrants and attorney's if they required involvement.


How to handle traffic tickets


First of be aware that most police officers do not know the full head on letter of the law. They are just there to manage the worldly situations but when it really comes to the laws is the attorney's who you should council from.

If you receive a traffic tickets and have doubt on anything don't just automatically pay it off. Research and see if you can take it to court if you find it to costly or trying to avoid getting it on your insurance record.

If the officer does not show you don't have to pay

Be aware as well that if your ticket does go to court and the officer does not show then it gets dismissed and you don't have to pay it. Most officers will write down all their tickets on one specific date so they can do them all in one day. So doing things like postponing the court date and maybe choosing something closer to a near holiday will increase your chances of the officer not showing up.

Trial by mail

Another thing you can do to overcome that traffic ticket is requesting a trial by mail. Most of the states still have this available by law. Since I live in Texas and have this privilege I recommend this action to be taken by many and anyone that comes to me with traffic tickets advice. When you set a court date the officer has a higher chance of showing up for the sole fact that it is overtime for them. If you request a trial by mail the officer must respond by mail as well to testify their side of the story. Most officers don't bother with having to submit this paperwork themselves so if they don't then you have won. Your ticket will be dismissed.

Speedy trial

Requesting a speedy trial can also allow you to get your tickets dismissed. By the Constitution you have the right to a speedy trial. The number of days that the state will be required to issue a speedy trial depends on its own state regulation, so their all different. If you live in a small city I would not recommend this but if you live in a big city chances are that with so many people to book for court dates and all the ones who already have them may not leave room for yours within the speedy trial day limit. If this happens then your case has to get dismissed by law. (When you go to the courthouse to request your court date don't sign the paper to waive your speedy trial privileged. If you do you won't be able to get one)
